June 2017 - John Sheahan QC for Respondent ACCC, Air New Zealand Ltd v Australian Competition and Consumer Commission; PT Garuda Indonesia Ltd v Australian Competition and Consumer Commission HCA 21 Sheahan QC appeared on behalf of the Respondent, ACCC. The Appellants were found by the primary judge to have been parties to understandings which amounted to price fixing with the imposition of surcharges on freight from ports in Asia to Australia; however the primary judge concluded there was no contravention of s.45(2) of the TPA because the competition occurred in Asia, not in any market in Australia. The Full Court, by a majority, allowed the appeal. The High Court (Kiefel CJ, Bell, Kearne, Nettle and Gordon JJ), dismissed the appeal. It held that there was a market in Australia for the airlines' air cargo services. The Court also rejected arguments by the appellants based on foreign state compulsion and statutory inconsistency.
